Change of Status
Understanding the Process of Changing Status
Did you know that you can take advantage of your stay in the United States and change your status to student? This is a great option for those who want to stay longer in the country, learn English, and explore local culture and customs. Additionally, your dependents, spouse (legally married), and children (under 21) can join you in your status change process, offering you the chance to enjoy an international experience together.
First, it’s crucial to understand the process of changing your status from tourist to student in the US. This procedure involves several steps, including submitting a request to USCIS (United States Citizenship and Immigration Services) to alter your status. Check out the necessary steps below.
Choosing a SEVP-Certified School that Provides the I-20
Initially, you must choose a school certified by the SEVP (Student and Exchange Visitor Program). Research institutions that offer programs compatible with your academic goals. Once accepted, the school will provide the I-20 form, essential for your status change request. This form confirms your admission and is necessary for your status change application. You can rely on MILA International Language Academy during this process. We are an English school with over 10 years of experience and authorized by SEVP to accept international students.
Paying the SEVIS Fee
After obtaining the I-20 form, you must pay the SEVIS (Student and Exchange Visitor Information System) fee. To make this payment, you will need your SEVIS ID, found on the I-20 form. The SEVIS fee must be paid before submitting your status change request to USCIS, as the payment receipt must be included in your application. The current SEVIS fee for F1 students is $350, but you can check the fee amount on the USCIS website.
Filling Out the I-539 Form
Next, you will submit your status change request. To do this, complete the I-539 form, Application to Extend/Change Nonimmigrant Status. This form must be filled out accurately and submitted along with the I-20 form and SEVIS fee payment receipt. It’s also important to include a letter explaining your reasons for the status change and any additional documentation that supports your intention to study.
Submitting the Request to USCIS
The complete application, including the I-539 form, I-20 form, SEVIS fee payment receipt, explanatory letter, and other supporting documents, must be sent to USCIS. Ensure you follow all instructions and submit all necessary documents to avoid delays or rejections.
Waiting and Maintaining Tourist Status
After submitting your request, you must wait for the USCIS decision. During this period, it’s essential to maintain your tourist status by adhering to all conditions of your B-1/B-2 visa. Continue following the rules of your tourist visa until the status change is approved. Avoid activities that may violate your current status.
When Status Change is Not Possible
In some cases, changing status from tourist to student is not allowed. For example, if you overstay the allowed period on your tourist visa, the status change will be impossible. Other restrictions that make you ineligible for status change include starting your studies without proper authorization, violating your current status conditions, or committing any crime.
Tips for a Successful Status Change
- Advance Planning: Start planning your status change in advance. Ensure you have enough time to prepare all necessary documents and follow the procedures correctly.
- Complete Documentation: Double-check that all required forms and documents are included in your request. Missing documents can result in delays or rejections.
- Legal Advice: Consider consulting an immigration attorney for professional guidance. An expert can help ensure you follow all steps correctly and maximize your chances of success.
- Stay Informed: Keep yourself updated on US immigration rules and regulations, as they can change. Visit the USCIS website for more information on the status change process.
